CLASSMATES POST
The amendment that drew my attention in great interest was the Sixth Amendment. The guaranteed right to criminal defendants to a public trial without unnecessary delays. This amendment details the rights a defendant has to any degree of the crime in questioning. The oversight of the smallest error could really give a defendant an easy walk to freedom. The 1963 case of Gideon vs. Wainwright revealed how a simple error and the right of the defendant could easily end with a win for the defendant. The Supreme Court overturned all the previous charges in favor of Clarence Gideon. The Supreme Court stressed that the right to counsel was a fundamental right that applies to all states. Again, the Sixth Amendment holds all parties accountable on all levels. It ensures that all citizens, not the government, control criminal justice, but the law will always be a constant opposition due to the constant change such as plead bargaining in regards to the Sixth Amendment. This is truly what intrigues me about the law and the thought of what would the foundering fathers think today.
